QlyQ Advertising: Terms Self-Serve

QLYQ SELF-SERVE ADVERTISING TERMS

(SME & Individual Advertiser Agreement)

These Self-Serve Advertising Terms (“Ad Terms”) govern your use of QlyQ’s self-serve advertising platform (“Ads Manager”).

By creating an ad account, submitting payment, or launching a campaign, you agree to these Ad Terms, the QlyQ Terms of Service, and applicable platform policies.

If you require negotiated commercial terms, you must enter into a separate Insertion Order agreement.

  1. Eligibility

To use QlyQ Ads Manager, you must:

  • Be at least 18 years old
  • Have legal capacity to enter binding agreements
  • Provide accurate billing and contact information
  • Comply with all applicable advertising and consumer protection laws
  • Not be subject to international sanctions

You may advertise as:

  • An individual
  • A sole proprietor
  • A registered business
  • An authorized representative of a company

You are responsible for all activity conducted under your ad account.

  1. Account & Payment Setup

You must provide:

  • Valid payment method (credit/debit card or approved payment method)
  • Accurate billing address
  • Tax identification information if required

QlyQ may:

  • Pre-authorize charges
  • Automatically charge your payment method
  • Suspend accounts for failed payments

You are responsible for any bank fees, chargebacks, or declined payments.

  1. Billing Model

Self-serve campaigns may operate on:

  • Prepaid credit system
  • Automatic recurring billing
  • Daily or lifetime budgets

Charges may be based on:

  • CPM (impressions)
  • CPC (clicks)
  • CPA (conversions)
  • Other performance models

All charges are exclusive of taxes unless stated otherwise.

  1. No Refund Policy

All advertising purchases are final.

Refunds will not be issued except:

  • Where required by law
  • In cases of clear technical billing errors confirmed by QlyQ

Chargebacks or payment disputes may result in immediate account suspension.

  1. Ad Review & Approval

All ads are subject to automated and manual review.

QlyQ may:

  • Approve or reject ads at its sole discretion
  • Remove ads after approval
  • Request modifications
  • Restrict targeting

Approval does not constitute legal compliance confirmation.

You are solely responsible for your ad content.

  1. Prohibited & Restricted Advertising

You may not promote:

  • Illegal goods or services
  • Fraudulent schemes
  • Misleading financial claims
  • Counterfeit products
  • Hate speech or harmful content
  • Unapproved health or medical claims
  • Adult content (unless expressly permitted)

QlyQ may restrict categories such as:

  • Gambling
  • Cryptocurrency
  • Political advertising
  • Financial services

Additional documentation may be required for regulated industries.

  1. Performance & Reporting

QlyQ provides performance metrics such as:

  • Impressions
  • Clicks
  • Engagement
  • Conversion tracking (if integrated)

However:

  • Metrics may be estimated
  • Invalid traffic may be filtered
  • Fraudulent activity may be deducted

QlyQ does not guarantee:

  • Views
  • Sales
  • Conversions
  • ROI

All performance risk is borne by the advertiser.

  1. Invalid Activity & Fraud

You may not:

  • Use bots or automated systems
  • Manipulate clicks or impressions
  • Incentivize fake engagement
  • Conduct coordinated fraud

QlyQ may:

  • Adjust metrics
  • Withhold credit
  • Suspend accounts
  • Permanently ban advertisers

Fraud determinations are final.

  1. Intellectual Property

You represent and warrant that:

  • You own or have rights to all ad content
  • Your ads do not infringe intellectual property rights
  • Your ads comply with applicable laws

You grant QlyQ a worldwide, non-exclusive license to display and distribute your ads for campaign purposes.

  1. Data & Targeting

If you upload audience data:

  • You represent you have lawful consent to use that data
  • You comply with data protection laws (GDPR, PDPA, etc.)
  • You will not misuse platform data

QlyQ may use anonymized and aggregated campaign data for analytics and platform improvement.

  1. Account Suspension & Termination

QlyQ may suspend or terminate your ad account for:

  • Non-payment
  • Policy violations
  • Fraud
  • Regulatory risk
  • Chargebacks

Suspension may occur without prior notice.

  1. Limitation of Liability

To the maximum extent permitted by law:

QlyQ shall not be liable for:

  • Lost profits
  • Business interruption
  • Campaign underperformance
  • Algorithm changes

Total liability shall not exceed the total amount paid by you in the preceding 30 days.

  1. Indemnification

You agree to indemnify and hold QlyQ harmless from claims arising from:

  • Your ad content
  • IP infringement
  • Regulatory violations
  • Misleading advertising
  1. Modifications

QlyQ may update these Ad Terms at any time.

Continued use of Ads Manager constitutes acceptance.

  1. Governing Law

These Terms are governed by the laws of Malaysia.

Disputes shall be resolved by binding arbitration in English unless prohibited by law.
